PUBLIC NOTICE: Planning Proposal – Changes to Lismore LEP 2012 to facilitate agritourism

Council is updating the Lismore Local Environmental Plan (LEP) 2012 to ensure there is suitable flexibility for rural and nature-based tourism uses, while protecting amenity and existing agricultural uses.

The intended outcomes of the planning proposal are to:

  • increase the maximum number of bedrooms permissible for farm stay accommodation (from 5 to 12);
  • allow development consent to be granted where rural and nature-based tourism development is accessed from a classified road;
  • ensure amenity concerns related to rural and nature-based tourism development are adequately addressed and considered;
  • ensure farm experience premises are of a suitable scale and do not adversely impact on agricultural production, scenic or environmental values; and
  • remove inconsistencies between the LEP and State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.

The planning proposal affects land on which farm stay accommodation is permissible with consent, and RU1 zoned land to which Clause 6.11 Rural and nature-based tourism development applies. Council is the designated local plan making authority for this planning proposal.

The planning proposal to amend the LEP is on exhibition from 17 April 2023 to COB 15 May 2023.

Along with the draft planning proposal, Council has also provided the Department of Planning and Environment’s Gateway determination.
