Public Notice - Proposed amendment to LCC Local Street Guide for Outdoor Dining

Council resolved at its November 2020 meeting to adopt the NSW Outdoor Dining Policy and User Guide for the entire local government area (LGA).
Council resolved at its August 2022 meeting to adopt the Outdoor Dining Local Street Guide, this guide does not allow for outdoor dining to be located along the shop front.
The Parking configuration of the South Lismore Business Precinct is rear to kerb, the outdoor dining user guide table 4 mandates the minimum distance from face of kerb to outdoor dining is 1.2 metres, with the minimum pedestrian clearance from outdoor dining being 2.0 metres. The footpaths in the precinct are approximately 3.6m - 3.8m in width, leaving only a narrow 40cm to 60cm space which is unsuitable for outdoor dining. This rear-to-kerb parking configuration is also considered to pose increased risks for patrons dining outdoor.
Given the parking configuration in the South Lismore Business Precinct, the adopted Outdoor Dining Local Street Guide does not accommodate outdoor dining in the precinct. Each outdoor dining application would be required to go to the Disability Access and Inclusion Advisory Group before going to Council for approval.
To streamline the process, given all eligible businesses in the South Lismore Business Precinct are bound by the same constraints, we propose to amend the Outdoor Dining Local Street Guide to allow Outdoor Dining along the shop front in the South Lismore Business Precinct.
The Disability Access and Inclusion Advisory Group approved the proposed amendment to LCC Local Street Guide at the meeting on 5 June 2024.
We propose to amend the Outdoor Dining Local Street Guide to allow Outdoor Dining along the shop front in this location only (Zoned E1 Local Centre – shown below highlighted blue). See attached proposed updated Outdoor Dining Local Street Guide with amendments highlighted for easy reference.
Amendment to the Local Street Guide
1. Accessibility
Access and usability for all people must be considered when determining whether a site and layout is suitable for outdoor dining. This includes a continuous, accessible path of travel to or within the area to provide access to all services and facilities. There must not be any hazard or impediment which prevents safe negotiation by any person.
Any item located within the outdoor dining area must;
- not obstruct nor protrude into the accessible path of travel;
- not be placed along the shopfront (this includes chairs and A-Frame signs); (excluding the South Lismore Business Precinct - see 1.3.a)
- be of a colour that provides a contrast with their background; and
- be designed so that it is accessible by all.
1.3a In the South Lismore Business Precinct outdoor dining is permitted along the shopfront. *Variations to the Local Street Guide Outdoor Dining Policy have been applied to the South Lismore Business Precinct in response to the precincts on-street carparking constraints.
- All furniture must be located within the licensed area, against the shopfront and must not at any time extend beyond the boundaries.
