Deferred Matter Rezoning Planning Proposal (Stage 2 Urban)

Council resolved to support a planning proposal for Deferred Matter (DM) Rezoning - Stage 2 Urban at its ordinary meeting of 11 June 2019 in accordance with the Environmental Planning and Assessment Act 1979.

The Department of Planning, Industry and Environment issued a Gateway Determination (preliminary approval) on 15 August 2019. An alteration to the Gateway was issued on 13 November 2019.

The Lismore Local Environmental Plan (LEP) 2012 was made on 22 February 2013 with lands adopted by Council as environmental protection zones shown on the LEP maps as DM. Such lands are currently zoned in accordance with the LEP 2000. Council has since been operating under two LEPs and two Development Control Plans (DCPs), which is an overly complex system of land use planning.

This planning proposal seeks to rezone 70 urban DM lots/part lots (138ha) under the Lismore Local Environmental Plan (LEP) 2012 and is the second stage of Council’s proposed DM rezoning. The proposed rezoning of DM land also involves the consequential amendment of numerous other LEP maps. An overview of the proposal is provided below:

The Minister for Planning and Public Spaces has not delegated the making of this LEP to Lismore City Council under section 3.36 of the Environmental Planning and Assessment Act 1979.

The planning proposal is exhibited for public comment from 26 February to 27 March 2020.
