Have Your Say on LEP Clause 5.22 – Special Flood Considerations
Lismore is updating the rules for building in flood-prone areas to better prepare for future flood events.
Lismore City Council is proposing to amend the Lismore Local Environmental Plan (LEP) 2012 to include optional clause 5.22 – Special Flood Considerations. This will enable Council to consider flood matters and apply development controls to sensitive and hazardous development on land between the flood planning area and the probable maximum flood (PMF).
The intended outcomes of the planning proposal are to:
ensure flood risk for sensitive and hazardous development in the Lismore LGA is appropriately considered.
enable the safe occupation and evacuation of people subject to flooding in floods greater than the defined flood event.
protect the operational capacity of emergency response facilities and critical infrastructure during large flood events.
avoid adverse effects of hazardous development on the environment during large flood events.
The planning proposal to amend the LEP is on exhibition from 19 June 2023 to COB 17 July 2023.
Along with the draft planning proposal, Council has also provided the Department of Planning and Environment’s Gateway determination.
This planning proposal has been prepared in accordance with the Department of Planning & Environment’s Local Environmental Plan Making Guideline September 2022. The Local Plan Making Authority for this Planning Proposal is the Department of Planning and Environment.
